1. Agreement to Terms
By accessing or using Palora at paloraapp.com, the Palora iOS application, or the Palora Android application (collectively, the “Service”), you agree to be bound by these Terms and Conditions (“Terms”). If you disagree with any part of these Terms, you may not access the Service.
2. Description of Service
Palora is a community-driven platform for rating and reviewing individual dishes at restaurants. Users can discover top-rated dishes nearby, submit ratings and reviews with photos, and explore restaurant menus based on real community feedback.
We reserve the right to modify, suspend, or discontinue the Service (or any part of it) at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.
3. Eligibility
You must be at least 13 years old (or 16 in the EEA/UK) to use the Service. By using the Service, you represent and warrant that you meet this age requirement. If we learn that we have collected personal information from a user under the applicable minimum age, we will take steps to delete the account and associated data.
4. User Accounts
To use certain features (such as submitting ratings and reviews), you must register for an account. You agree to:
- Provide accurate, current, and complete information
- Maintain the security of your account credentials
- Not share your account credentials with any third party
- Accept responsibility for all activity that occurs under your account
- Notify us immediately at support@paloraapp.com of any unauthorized use of your account
We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used fraudulently.
5. Acceptable Use
You agree not to use the Service to:
- Violate any applicable law or regulation
- Infringe on the intellectual property or privacy rights of others
- Submit fake, misleading, or fraudulent ratings or reviews
- Upload content that is defamatory, obscene, harassing, threatening, or otherwise objectionable
- Upload content that you do not have the right to share
- Attempt to gain unauthorized access to the Service, other user accounts, or any related systems or networks
- Interfere with or disrupt the Service’s operation or infrastructure
- Use automated tools (bots, scrapers, crawlers) to access, extract, or index data from the Service without our prior written consent
- Impersonate another person or misrepresent your affiliation with any person or entity
- Transmit viruses, malware, or any other harmful code
- Circumvent, disable, or otherwise interfere with security features of the Service
We reserve the right to remove content and suspend or terminate accounts that violate these rules, at our sole discretion and without prior notice.
6. User Content
You retain ownership of the content you submit to the Service, including ratings, reviews, and photos (“User Content”). By submitting User Content, you grant Palora a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to use, reproduce, display, distribute, and create derivative works of such content solely for the purpose of operating, promoting, and improving the Service.
You represent and warrant that:
- You own or have all necessary rights and permissions to submit the User Content
- Your User Content does not violate the rights (including intellectual property, privacy, or publicity rights) of any third party
- Your User Content is truthful and reflects your genuine experience
We reserve the right to remove any User Content that violates these Terms or that we find objectionable, without prior notice and at our sole discretion.
If you delete your account, your ratings and reviews will be retained in an anonymized form (no longer associated with your identity) to preserve the integrity of community content. This is described in detail in our Privacy Policy.
7. Intellectual Property
The Service and its original content (excluding User Content), features, functionality, design, and underlying technology are and will remain the exclusive property of Palora and its licensors. The Service is protected by copyright, trademark, trade dress, and other intellectual property laws of the United States and applicable international jurisdictions.
The Palora name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Palora. You may not use them without our prior written permission.
8. Restaurant and Dish Information
Restaurant information displayed on Palora is sourced from third-party services including the Google Places API and Google Places SDK. While we strive to display accurate information, we do not guarantee the accuracy, completeness, or timeliness of restaurant details such as hours, menus, prices, or locations.
Palora is not affiliated with, endorsed by, or sponsored by any restaurant listed on the platform. Ratings and reviews reflect the opinions of individual users and should not be relied upon as the sole basis for dining decisions, including decisions related to food allergies or dietary restrictions.
9. Account Deletion and Termination
By you: You may delete your account at any time from the Settings screen within the iOS or Android app. You may also request deletion by emailing support@paloraapp.com. Upon deletion, your personal account data will be permanently removed. Anonymized reviews and ratings will be retained as described in our Privacy Policy.
By us: We may suspend or terminate your access immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease. Provisions of these Terms that by their nature should survive termination (including ownership, warranty disclaimers, indemnification, and limitations of liability) will survive.
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICE OR THE SERVERS THAT MAKE IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
Ratings and reviews on Palora reflect the opinions of individual users and do not represent the views of Palora. We do not guarantee the accuracy, reliability, or completeness of any user-submitted content.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PALORA, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH:
- Your use of or inability to use the Service
- Any conduct or content of any third party on the Service
- Any User Content obtained from the Service
- Unauthorized access, use, or alteration of your transmissions or content
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID US, IF ANY, IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
12. Indemnification
You agree to indemnify, defend, and hold harmless Palora and its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or expenses (including reasonable attorneys’ fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your User Content; or (d) your violation of any third-party rights.
13. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to conflict of law principles.
Any dispute arising under or in connection with these Terms shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved informally within 30 days, it shall be subject to the exclusive jurisdiction of the state and federal courts located in the State of California.
14. Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect. The invalid or unenforceable provision will be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.
15. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Palora regarding your use of the Service and supersede all prior agreements, understandings, and communications.
16. Changes to Terms
We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the new Terms on this page and updating the “Last updated” date. For significant changes, we may also provide notice through the Service. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms. If you do not agree with the revised Terms, you must stop using the Service.
